RULES - Spring Giveaway

OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SPRING GIVEAWAY CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.

How To Enter:

Beginning 6:00:01 a.m. (PST) on March 5, 2008, and ending March 12, 2008, at 11:59:59 p.m. (PST) (length of the “Spring Giveaway!” contest) go to http://www.emitations.com/springgiveaway.html and enter your email in the field titled "Sign up now to win". At 11:00 a.m. (PST) each week day (Monday-Friday) a winner will be randomly selected from all eligible email entries from March 5, 2008, through March 12, 2008. Except as provided below, the entry period for each day during the Spring Giveaway period will begin at 6:00:01 a.m. (PST), and end on the following day. The entry period for the final day of the Spring Giveaway will begin at 6:00:01 a.m. (PST) on March 11, 2008, and end at 11:59:59 p.m. (PST) on March 11, 2008. A separate drawing will be held on each day during the Spring Giveaway contest, however, only one entry total is necessary to be eligible for each day's drawings. ONE REGISTRY/ENTRY PER NAME AND EMAIL ADDRESS. ATTEMPTS TO CREATE MULTIPLE REGISTRIES WILL NOT INCREASE YOUR ODDS OF WINNING, AND WILL RESULT IN DISQUALIFICATION. All entries will be eligible to be drawn each day, and all non-winning entries each day will automatically go back into the pool of eligible entries for each day remaining in the promotion. Winning entries will NOT be eligible to win prizes on the remaining days of the promotion. Sponsor is not responsible for lost, late, misdirected, incomplete, inaccurate, mutilated, entries. By entering the Spring Giveaway contest, you consent to being placed on a mailing list for promotional and other materials unless you have indicated otherwise on the entry form.

Eligibility

Open to legal residents of the 50 United States and the District of Columbia who have reached the age of majority in their state of residence at time of entry. Void where prohibited by law. Employees of Sponsor, its parents, affiliates and subsidiaries, participating advertising and promotion agencies and prize suppliers (and members of their immediate family and/or those living in the same household of each) are not eligible.

Random Drawing

Beginning March 5, 2008, a random drawing to select a winner will be held each day at 11:00 a.m. (PST) during the Spring Giveaway contest period, from among all eligible entries. Each drawing will be from all eligible entries received to that point during the span of the Spring Giveaway contest period. Decisions of judges are final and binding. Winner will be notified vie e-mail everyday of the Spring Giveaway contest. Odds of winning will depend upon the total number of eligible entries received for each drawing.

Prizes and Approximate Retail Value

One (1) prize will be awarded each day during the Spring Giveaway Period, consisting of one (1) jewelry set item, according to the attached Schedule running March 5, 2008, through March 12, 2008. Standard USPS 10 day shipping of prizes will be provided at no cost to contest winners. All other expenses not specified herein are the responsibility of the winner.

Conditions of Participation

Winner may forfeit prize if Sponsor is unable to contact him or her within three (3) days of first attempted notification. In such event, the prize may be awarded to an alternate winner. Sponsor reserves the right to substitute prize for an item of equal or greater value. The prize is awarded without warranty of any kind from Sponsor, express or implied, without limitation. Winners may not exchange or return prize jewelry for cash value or alternate items. All federal, state and local laws and regulations apply. Entrants agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Spring Giveaway contest. Potential winners will be required to sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release within three (3) days following the date of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize.

Restrictions

Acceptance of the prize constitutes permission for Sponsor and its agencies to use winners’ names and/or likenesses for advertising and promotional purposes without additional compensation, unless prohibited by law. By entering, participants agree to hold Sponsor, its parents, affiliates, subsidiaries and their respective directors, officers, employees and assigns harmless for any injury or damage caused or claimed to be caused by participation in the Spring Giveaway contest, even if caused or contributed to by the negligence of Sponsor. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Spring Giveaway contest or in the announcement of the prize. Only the number of prizes stated herein will be awarded. In the event any technical errors occur in the selection of a winner and more prizes are claimed than the number of prizes being awarded as provided herein, Sponsor reserves the right to award the prize by random drawing from among all eligible claimants.

Internet

Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Spring Giveaway contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Spring Giveaway contest. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by an entrant to deliberately damage any Web site or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such entrant to the fullest extent of the law.
